What information should I gather before I call about my litigation?

Before calling to inquire about your litigation matter, be sure to have important information about the situation readily available. The first step on the case intake end is to run a conflict check within our internal system to assure there is no conflict of interest with any parties involved. You will want to have all parties first and last names and/or business names to share with the paralegal taking your initial call.

What is a small claims case?

A small claims case is any case you seek to obtain $10,000 or less. If the amount you are looking for is greater than $10,000, the case is considered a large claims civil case.

Is there a retainer required for litigation cases?

For any new litigation matter we do require a retainer fee to begin your case due to the intensity and complexity of most litigation matters. The amount of this fee differs based on several determining factors. To get a retainer fee quote, please call 262-334-3471.

Can I sue for my attorney fees?

In Wisconsin, the general rule is that each party to litigation pays for their own attorney fees.  There are a few notable exceptions to this rule, however, and a recent decision by the Wisconsin Court of Appeals, affirming the circuit court’s findings, ruled that a beneficiary who filed numerous baseless lawsuits regarding the administration of two trusts caused unnecessary fees and expenses to be incurred.  Those fees and expenses were ordered to be taken from the beneficiary’s portion of the proceeds from the trusts.  While this case is an exception to the rule, a beneficiary would do well to consider it before bringing actions against an estate.
